If you’re a consultant or a subcontractor on a large project team, you may have noticed (or possibly, ignored ??) lots of documents at the end of your contract. These might include all sorts of things: a list of the Principal’s policies, a collateral warranty, a sample stat dec, some deeds of novation, the kitchen sink… You get the idea. Sometimes clients ask me about these extras. And one of the questions is: Gemma, what is a Deed of Final Release?Read the full blog post here https://lnkd.in/gBhbFXF4#construction #engineering #consulting #riskmanagement #contractisnotadirtyword

Deeds of Release can indeed be very sneaky where strings are attached and you are required to sign off to get your final payment. One could argue in such a form they are effectively contracting out of Security of Payment Legislation. If a payment is due then it should be paid.

SoundLegal Client Feedback ..."Gemma was recommended by a lawyer that was too busy to handle our contract negotiation. I am so happy that was the case as working with her was a pleasure. She could understand the situation we were in and was all over the contract negotiation. Most of all very understanding and down to earth. Can not recommended her enough"Steven Tait#contractlaw #constructionlaw #constructionlawyer #lawyerblog

As every small business owner knows, cash is king. But in my experience, a lot of business owners don't realise they can use their contract to promote cash flow. In this video I'm sharing some tips about what I look for when I review payment clauses. Bonus points to anyone who can spot why I'm a lawyer and not an accountant in this video ;)https://lnkd.in/dH2N8EE6#construction #engineering #consulting #riskmanagement #contractisnotadirtyword

Do you know what to look for when you review a contract? You're not going to want to pay a lawyer or a contract specialist to review every single contract that passes through your business. Sometimes they're short, or they're straightforward, or the project fee is low and doesn't justify a legal spend. Do you want to know the 10 clauses that I focus on when I review construction, engineering and consulting contracts? I've come up with a checklist that lays it all out for my mailing list subscribers. You can find the link to it here: https://lnkd.in/gEYvMRN I'd love to hear what you think... what's your number one contract hot button? #construction #engineering #contractisnotadirtyword
